WebSoul's POLICY and GUIDELINES:
WebSouls provides web hosting to numerous clients which means that we have a responsibility to protect each client and to provide the best services available. The following guidelines were established to ensure these crucial obligations are met.
These Policies, Guidelines, and Disclaimer are intended for all domains residing on WebSouls servers. WebSouls reserves the right to change these Policies without prior notice or warning. Non-enforcement of any part of these Policies does not constitute consent. WebSouls reserves the right to terminate an account at any time and for any reason that causes harm to any WebSouls customer's web sites. Further, WebSouls shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of WebSoul's Server.
Payments:
Customer will be responsible for charges as per rate schedule associated with registration of domain name in advance including but not limited to all costs for moving or transferring such domain name. Domain registration confirmation will be send to you after 24 hours of payment. WebSouls have the right to change the charges without any notice to the customer, which would be applicable for renewal of the registration.
Renewal:
Customer shall be notified when renewal fees are due. Should these charges go n unpaid within stipulated period in the second notice/ reminder regarding renewal, the registration will be cancelled, and WebSouls will not be responsible if the domain is registered by any other person, after the expiry of registration term.
Change of Plans/ Increase in Hosting Quota:
For further increase in hosting space the formal contract will be rendered inactive and new will be signed thereof as per space acquired and the charges recurring during that set period of time.
Reseller Policies:
WebSouls always respect the premisses of its prospective clients, especially the "Resellers",as no business can grow until or unless there is a group of clients that engulfs its verstality in positive manner.The way WebSouls always respect the domains and parameters of its resellers, on other hand we dont allow the customers to violates the principles of Hosting and Host(WebSouls).If any individual customer has any complaint or inconvenience with any of our Reseller than WebSouls (The Host) has complete authority to undertake the whole situation and can take necessary measures in that regard.As we believe in equality of liberty for both the person having 50 MB of Hosting and with the person having account in GBs.
Cancellation Policy:
If customer cancels this agreement prior to the end of the term specified in order form, WebSouls, shall not refund fees paid in advance of such cancellation. Customer will be required to pay 100 % of WebSouls standard yearly charges of the term. For security, all cancellation request must be made by the primary contact person on the account who must provide sufficient customer identification information. Any such request shall be effective upon receipt. Any cancellation shall not relieve the customer of any obligations to pay fees accrued prior to such cancellation
Abuse of WebSouls Server Resources:
Running programs in the background on a WebSouls's server without WebSouls's prior written authorization, or running chat rooms, Internet Relay Chat, IRC bots, and the like are not acceptable uses of Host Assured's servers. Further, any usage of ten percent (10%) or more of our system resources is an undue burden on our system and is unacceptable. If your usage ever exceeds ten percent (10%) of system resources, Abuse of the law:
WebSouls reserves the right to report illegal activities to any and all regulatory, administrative, and/or governmental authorities for prosecution. Pornography and sex-related merchandising, or links to such material, even if legal, is not an acceptable use of WebSouls's servers. WebSouls's services may be used for lawful purposes only. Illegality includes but is not limited to: drug dealing; attempting without authorization to access a computer system; pirating (distributing copyrighted material in violation of copyright law, specifically MP3s, MPEG's, ROMs, and ROM emulators); gambling; schemes to defraud; trafficking in obscene material; sending a message or having content that is obscene, lewd, lascivious, filthy, or indecent with intent to annoy, abuse, threaten, or harass another person; threatening bodily harm or damage to individuals or groups; violating U.S. export restrictions; stalking; or violating other state or federal law such as the Electronic Communications Privacy Act, the Computer Fraud and Abuse Act, or the Economic Espionage Act. Linking to illegal material is also prohibited. WebSouls reserves the right to check system files, email, and other data on our servers for illegal content and materials, or for any other reasons deemed necessary.
Spamming/Marketing:
These include spamming (sending unsolicited advertising to those with which the customer has no existing business relationship, posting off-topic advertising in newsgroups); spoofing (using a return email address which is not the valid reply address of the sender or sending an email message which does not contain enough information to enable the recipient to identify the party who is really sending the message; passive spamming (promoting a web site hosted by WebSouls by spamming from some other source), trolling (posting controversial messages in newsgroups to generate responses), mail bombing (inundating a user with email without any serious intent to correspond), generating a higher volume of outgoing mail than a normal user (10% or more of available system resources), and subscribing someone else to an electronic mailing list without that person's permission. A message is considered unsolicited if it is posted in violation of a newsgroup charter or sent to a recipient who has not requested the message. Making an email address available to the public does not constitute a request to receive messages. Distribution of mass emailing programs is also prohibited. All recipients on a mailing list must have personally subscribed. Mailing lists may not be used to distributed unsolicited email. Any customer repeatedly "mail bombed" or that attracts such behavior will be asked to leave. If you are not sure if your actions will be in violation, Please ask First form abuse@websouls.com. Please be advised that if your account is suspend due to the fact that you were intentionally setting up an account for the purposes of spamming no refunds will be given. There are no exceptions to this rule.
CLIENT RESPONSIBILITY:
The client is responsible for all activity originating from the account unless proven to be a victim of outside hacking or address forgery. The client is responsible for securing their username/password. Use of WebSouls's service requires a certain level of knowledge in the use of Internet languages, protocols, and software. This level of knowledge varies depending on the anticipated use and desired content of the web space by the client. The following examples are offered: Web Publishing: requires knowledge of HTML, properly locating and linking documents, FTPing Web contents, Graphics, text, sound, image mapping, etc. FrontPage web publishing: knowledge of the FrontPage tools as well as Telnet and FTP understanding and capability.
Data Back Up Service.
WebSouls will not be responsible of your data as we provided you data backup utility in your control panels. However you can get a paid data backup service from us so we must have a weekly backup of your data. If you are not getting this service from us then we will not provide your data in case of hacking / virus attack / data deletion by mistake ext. You can secure your data with us by paying PKR:1000/- for 1GB space and it will renew on yearly basis.
Authorization of Client:
Websouls will not provide Details related to your account, user name password of control panel or any other info except your authorized email id which you have gave while registering your account. We will not take any action until you send us email from your authorized email id. You can add two or more email ids by email form authorized email id.
Unauthorized Access:
Use of the WebSouls service to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of HostRock.Net's or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending WebSouls account is subject to immediate termination.
Copyright or trademark infringement:
Use of the WebSouls service to transmit any material (by e-mail, uploading, posting or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.
